Draft law to establish EPR for textiles and footwear
A Draft Royal Decree, released in June 2025, aims to establish EPR for textiles and footwear products, as mandated by the Spanish Law (7/2022) for circular economy.
With this, Spain joins several countries, such as France, Italy and the Netherlands, preparing for the rollout of mandatory EPR for textiles across the EU.
Compliance and fees
Notably, the draft only allows collective compliance through producer responsibility organisations (PROs) and sets ambitious textile waste targets: 50% separate collection by 2030 (70% by 2035), with 20% prepared for reuse by 2030 (35% by 2035).
Producer fees will be based on the weight of the textile and footwear products introduced to the market that fall under Annex I. Or, if appropriate, the fees will be based on the number of units.
Additionally, these fees will be eco-modulated based on eco-design requirements set out in the forthcoming textile-specific delegated act under the EU’s 2024 Ecodesign for Sustainable Products Regulation (ESPR).
Retailer obligations
Retailers must collaborate with the PROs on separate collection, finance collections (if also acting as a producer), and share sales information on covered products.
They are only allowed to sell duly registered products.
If their retail space exceeds 400m², they must dedicate a sales area for second-hand (‘prepared for reuse’) textile or footwear products.
Product registry
The draft also establishes a new section under the Registry of Product Producers for textiles and footwear.
Producers and their authorised representatives must register and annually report detailed information on the types of products that they place on the market, including their quantities.
Producers established in a third or another EU country must appoint an authorised representative to fulfil their obligations.
Meanwhile, online platforms may only provide their services to obliged producers after obtaining their registration number and declaration of compliance with EPR.
Textile services and support
ERP España is positioning itself to provide compliance services ahead of the decree publication which is currently undergoing public consultation until September 2025.
