EU REACH: five new hazardous chemicals on the Candidate List
The European Chemicals Agency (ECHA) has added five hazardous substances and updated an existing entry on the Candidate List of substances of very high concern (SVHC) for Authorisation.
The substances include persistent, bioaccumulative and toxic chemicals that are used in lubricants, greases, metal working fluids, personal care and cleaning products, coatings, sealants and adhesives.
One substance (Perfluamine, CAS number 206-420-2) is used in the manufacture of electrical, electronic and optical equipment and machinery and vehicles and may thus be particularly relevant to Landbell Group’s clients across various waste streams services. The list currently contains 247 entries for hazardous chemicals, some of them are groups so the actual number of substances is higher.
What does it mean for companies?
European producers, importers and suppliers of products containing a Candidate List substance must:
- inform their customers of its presence, provide sufficient information on safe use, and notify ECHA (REACH Regulation), and
- notify ECHA’s database of substances of concern in products (SCIP), if the articles they produce or import contain SVHCs in a concentration > 0.1% weight by weight (Waste Framework Directive)
Products containing SVHCs cannot have the ecolabel award (Ecolabel Regulation).
The substance may be placed on the Authorisation List in the future. If so, its use will be prohibited unless a company obtains authorisation for its use from the European Commission.
Ukraine REACH and CLP enter into force
Ukraine REACH entered into force in January 2025, with pre-registrations lasting until January 2026 and first registrations due by October 2026.
The Ukrainian Classification, Labelling and Packaging (CLP) Regulation is already in force and classification and labelling (C&L) notifications for phase-in substances must be submitted by 15 November 2025.
Ukraine REACH
Ukraine’s EU-aligned chemical products safety law – Ukraine REACH – entered into force on 26 January 2025. The national Technical Regulation on the Safety of Chemical Products mirrors EU REACH thus the main provisions and requirements are already familiar to clients active in the European market.
Ukraine’s REACH Regulation requires mandatory registration of all chemicals produced, imported or placed on the market in Ukraine at one tonne or more per year. It also provides for the creation of a database containing information on the properties, risks and safe use of chemicals.
Ukraine CLP
Ukraine’s CLP Regulation – Technical Regulations on Hazard Classification, Labelling and Packaging of Chemical Products – entered into force on 15 November 2024. It mirrors EU CLP and implements the international Globally Harmonized System of classification and labelling system for chemicals (GHS).
